White collar crime is a category of crimes associated with businesses. These types of non-violent crimes can include embezzlement, forgery, computer crime, securities fraud, mail fraud, wire fraud, extortion, bribery, and bad checks, to name a few.
First, do you believe that these crimes are equally as bad, worse, or not as bad for society as violent crimes? Why?
Second, of the types of white collar crimes listed above, which one do you believe negatively affects society the most? (you must only pick one) To support your answer, please provide a real example of the crime you have chosen (e.g., the Bernie Madoff or Enron scandals – please do not use these examples; you must provide a different example), along with a complete explanation of the situation, your thoughts on the situation and a citation to a source.
Third, please read the court`s decision in Louisiana v. Hamed p. 113-114. If you were the prosecutor in the case, what would your argument have been on appeal as to why you believe the defendant actually committed the crime? If the defendant`s conviction was upheld on appeal, what type of punishment/sentence do you believe would have been appropriate in this case? Why? Complete answers will reference the facts and the law from the case.
